Introduction

MemCull (hereinafter referred to as "the App") is a local gallery management tool dedicated to protecting user privacy. We understand that photos carry users' most precious private memories, so our core design philosophy is "local processing, privacy first". This agreement details how we process data and the technical measures we take to protect your data security.

1. Data Processing Principles and Scope

1.1 Local-First Processing

The App's core features (including random display of photos/videos, swipe filtering, recycle bin management, Live Photo recognition, video likes, etc.) are all completed locally on your device. The App will not upload the binary content of your photos or videos to any cloud server or third party.

1.2 Metadata Processed

To track your organization progress and prevent repeated display, the App stores the following non-sensitive metadata locally:

  • Unique identifier of processed photos (Asset ID)
  • Processing status (kept or moved to recycle bin)
  • Organization statistics (number of deleted photos and freed storage space)
  • Live Photo recognition cache (local flags to avoid repeated detection)
  • Video like records (for the "Liked Videos" album, only video Asset IDs are saved)
  • Necessary app settings (language, display options, location service configuration, etc.)

1.3 Location Information

The App reads the latitude and longitude from photo EXIF information only when you actively enable the "Show Specific Location" feature. If you further configure a reverse geocoding service (such as Amap or HERE), the App will send the coordinates to your chosen provider via HTTPS encryption for address resolution. This process does not include your photo content, account information, or other personal identity data.

1.4 Payments and Donations

If you choose to make a donation/subscription within the App, the payment process is handled by Google Play's billing system. The App does not collect or store your bank card number or other payment information. To unlock the "Supporter" status display, the App may save necessary purchase status information locally.

2. Technical Security Measures

We implement the following technical measures to ensure your data security:

  • Sandbox isolation: All local databases (SQLite) and configuration files are stored in the App's private sandbox on Android, inaccessible to other third-party apps.
  • Minimal permissions: The App requests photo album read/write permissions only when necessary, and does not request irrelevant permissions such as phone or contacts.
  • No account system: We do not establish any user accounts, so there is no risk of personal identity leakage from database breaches.
  • Transparent deletion logic: The App uses a "Recycle Bin" as a buffer layer. Physical deletion operations must be confirmed again by the user in the system permission dialog, ensuring every deletion step is under your control.

3. Third-Party Services and SDKs

To optimize the experience, the App integrates only a small number of necessary third-party services:

  • Amap Open Platform: Used for geographic location resolution only after the user configures their personal API Key.
  • HERE: Used for geographic location resolution only after the user configures their personal API Key.
  • Firebase Analytics (Google): Used to collect anonymized usage statistics and performance metrics to help us improve the experience.
  • Google Play Billing (In-app Purchase): Used to process in-app donation/subscription payments.

4. Terms of Service

4.1 User Responsibility

Users understand that organizing and deleting photos are irreversible operations (after completely emptying the recycle bin). When using random display mode, please carefully identify photo content before swiping to confirm. The developer is not liable for compensation for unintended deletions caused by user error.

4.2 Disclaimer

The App is provided "as is" without any express or implied warranties. Although we minimize the risk of accidental deletion through the recycle bin mechanism, we strongly recommend users regularly perform system-level backups of important visual materials.

4.3 No Warranty

To the maximum extent permitted by law, the App does not warrant that: the App will always be uninterrupted, error-free, or completely secure; any feature will always be accurate, timely, or available; any defects will be fixed. You understand and agree to assume all risks of using the App.

4.4 Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable under any circumstances for any loss arising from the use or inability to use the App, including but not limited to: data loss, accidental deletion, device damage, compatibility issues, operation failures caused by system limitations, business interruption, lost profits, loss of goodwill, etc.

4.5 Liability Cap

To the maximum extent permitted by law, regardless of the cause or type of claim (contract, tort, or otherwise), the developer's total cumulative liability to you for the App shall not exceed the total amount you actually paid for the App (if any). If you did not pay any fees, to the maximum extent permitted by law, the developer shall not be liable for any losses.

4.6 User Indemnification

If any third party makes a claim, penalty, or suffers loss due to your use of the App, your provision or configuration of third-party API Keys, content you process, or your violation of these terms, you agree to bear full responsibility and indemnify the developer for all losses, expenses, and reasonable costs (including attorney fees) suffered thereby.

4.7 Third-Party Services Disclaimer

The App may rely on or integrate third-party services (such as Amap, HERE, Firebase, Google Play Billing). The availability, accuracy, security, pricing rules, and data processing methods of third-party services are determined by their respective terms and policies. The developer is not responsible for losses caused by third-party service interruption, modification, unavailability, or any third-party reasons.

4.8 Dispute Resolution and Terms Updates

These terms may be adjusted from time to time due to product updates or compliance requirements. Updated terms will be published on the official website with the "Last Updated Date" as the standard. Your continued use of the App constitutes acceptance of the updated terms. In case of disputes, both parties should first attempt friendly negotiation; if negotiation fails, submit to a court with jurisdiction.

5. Your Rights

You have absolute control over your data:

  • You can clear all organization records in Settings at any time.
  • Uninstalling the App will automatically clear all processing records and configurations stored in the local sandbox.
